Booking agreement

Please read the terms of your stay carefully before submitting your request. By submitting it you confirm that you have done so and that you accept them on behalf of your entire party.

1. Status of this request

Submission of this form constitutes a request to reserve the dates selected. It does not create a reservation, and no payment is taken or authorised at this stage. The dates are held while we confirm availability and review the request. A reservation comes into existence only upon our written confirmation. Should we be unable to accommodate the dates requested, the hold is released and you are notified.

2. Charges and payment

The amounts displayed comprise the nightly rate for the accommodation selected, any applicable cleaning fee, and Texas hotel occupancy tax. The total is confirmed to you in writing before a reservation is made. Payment method, deposit, cancellation, and refund terms are governed by the written agreement for your stay and are not established by this form.

3. Accuracy of the information provided

You warrant that the contact details and trip information submitted are accurate and that you are authorised to provide them on behalf of your party. The stated occupancy of each accommodation is a maximum and is enforced; please declare your party in full.

4. Acknowledgement of property conditions and risk

Heram Al Noor is a working rural retreat in the Texas Hill Country, and the terrain is natural and substantially unpaved. Conditions here differ materially from those of a hotel or a serviced resort, and several of the features guests come for are unsupervised by design.

Accordingly, you acknowledge that a stay at the property involves, without limitation, the following conditions and the risks inherent in each of them:

• uneven terrain, loose stone, stairs, decks, and elevated platforms, presenting a risk of slips, trips, and falls;
• wildlife and insects native to the area, including snakes, spiders, scorpions, and bees from the working apiary;
• heat, sun exposure, dehydration, storms, lightning, and flash flooding;
• the natural stone pool, hot tub, and pond, which are chemical-free, unstaffed, and without lifeguard supervision, presenting risks including slipping, drowning, thermal shock, and organisms inherent to untreated water;
• the wood-burning sauna and hot tub, presenting risks including burns, overheating, dehydration, fainting, and cardiovascular strain. Consult a physician before use if you are pregnant or have a heart condition;
• open flame from fire pits, candles, and the sauna stove;
• shared kitchens, allergens, and food prepared by guests or third-party caterers;
• remoteness, including extended emergency response times, limited mobile coverage, and the absence of medical personnel on site.

You are responsible for assessing the fitness of yourself and every member of your party for these conditions. Texas law, including the Texas Agritourism Act, may limit liability for risks inherent to agritourism activities. Nothing in this agreement waives any liability that cannot lawfully be waived.

5. Minors

Guests under 18 must be accompanied and supervised at all times by a parent or legal guardian while on the property. Additional age and supervision requirements may be imposed for the water and heat facilities.

6. Conduct on the property

You agree to observe posted signage, quiet hours, fire restrictions, and the instructions of staff, and to treat the land, wildlife, structures, and other guests with due care. Rules governing smoking, alcohol, pets, and quiet hours are communicated before or during your visit and are binding on your party.

7. Personal property and damage

You remain responsible for your belongings and vehicles throughout your stay. The property is rural and largely open, and we accept no responsibility for loss, theft, or damage to personal property except to the extent applicable law provides otherwise. You are responsible for damage to the property, its structures, furnishings, and equipment caused by you or your party beyond normal wear and tear, and you agree to report any damage or breakage promptly.

8. Third-party vendors

Caterers, photographers, celebrants, musicians, and other vendors engaged by you remain your responsibility, including their conduct, equipment, and removal of materials. Vendors are bound by the same rules as guests, and we reserve the right to decline any vendor or activity that presents a safety or property risk.

9. Events beyond reasonable control

We are not liable for failure to host a confirmed stay where prevented by events beyond our reasonable control, including severe weather, wildfire, flood, failure of power or water, or governmental order. Any rebooking, refund, or other remedy is governed by the written agreement for your stay and by applicable law.

10. Personal information

Information submitted through this form is used to respond to your request and to administer your stay, as described in our Privacy Policy.

11. Governing law and venue

This agreement and your visit are governed by the laws of the State of Texas. Any proceeding that cannot be resolved informally shall be brought in the state or federal courts of the county in which the property is located. We ask that you raise any concern with us directly in the first instance.
