These Terms of Service ("Terms") govern your use of the Heram Al Noor website and your visits to the Heram Al Noor property near Wimberley, Texas (the "Property"), operated by Heram Al Noor and its owner/operators. By using this website, submitting an inquiry or a booking request, or visiting the Property, you agree to these Terms.

1. Booking requests, inquiries, and what confirms a stay

This website accepts booking requests and inquiries. It takes no payments and cannot confirm a stay by itself. When you submit a booking request you choose dates and what you would like to book, and we hold those dates while we review the request. Holding dates is not a reservation: a stay, event, or rental is confirmed only by a direct written agreement from us, and if we decline the request or cannot accommodate the dates we release the hold and tell you.

Before a booking request can be sent you are asked to read and accept the booking agreement. We record that acceptance together with the wording that was in force at the time.

Submitting the inquiry form is a request for contact only. It does not create a reservation, hold dates, or promise availability, pricing, or a response time.

The site stores no payment card data and does not process payments. Amounts shown while you choose dates are an estimate of the nightly rate, any applicable fee, and lodging tax; they are not a charge and not a final total. Pricing, deposits, payment methods, cancellation, and refund terms are binding only as stated in the separate written agreement for each accepted stay, event, or rental.

2. Accuracy of what you send us

You agree that the contact details and trip information you submit are accurate and that you are authorized to share them. Automated, bulk, or fraudulent submissions are prohibited; the form applies anti-abuse measures described in the Privacy Policy.

3. Visitor conduct

While on the Property you agree to follow posted signs, quiet hours, fire rules, and staff instructions; to supervise minors in your party at all times; and to treat the land, wildlife, structures, and other guests with care. Smoking, alcohol, quiet-hour, pet, and other property rules are communicated before or during a visit and must be followed.

4. Property risks you accept

The Property is a rural Texas Hill Country retreat. Conditions are natural and largely unpaved. Risks include, without limitation:

  • uneven terrain, loose stone, stairs, decks, and elevated platforms, with risk of trips and falls;
  • wildlife and insects, including snakes, spiders, scorpions, bees from the working apiary, and other animals native to the area;
  • heat, sun exposure, dehydration, storms, lightning, flash flooding, and other weather;
  • the natural stone pool, hot tub, and pond: these are chemical-free natural water features, unstaffed and without lifeguards; risks include slipping, drowning, thermal shock, and waterborne organisms inherent to untreated natural water;
  • the wood-burning sauna and hot tub: heat-related risks including burns, overheating, dehydration, fainting, and cardiovascular strain; consult a physician before use if pregnant or if you have a heart condition;
  • open flame from fire pits, candles, ceremony use, and the sauna stove;
  • food service, shared kitchens, and allergens, whether food is prepared by guests, caterers, or other providers, and the possibility of allergic or food-borne illness;
  • communicable illness among gathered groups;
  • remoteness: emergency response times are longer than in a city, cell coverage may be limited, and on-site staff are not medical providers.

You are responsible for judging your own fitness for these activities and for the fitness of minors in your care.

5. Assumption of risk, release, and indemnity

By visiting or participating in activities at the Property, you acknowledge the inherent risks described above and agree to act reasonably for your own safety and the safety of your party. To the fullest extent permitted by law, you assume inherent risks that cannot be eliminated by reasonable care. This section is not intended to waive liability that cannot lawfully be waived. A signed agreement for a stay, event, or rental may include additional release and safety terms, and that agreement controls where it differs.

Texas law, including the Texas Agritourism Act (Texas Civil Practice and Remedies Code Chapter 75A), may limit liability for inherent risks of agritourism activities where its notice requirements are met.

6. Minors

The website is directed at adults planning stays and gatherings. Guests under 18 must be accompanied and supervised by a parent or legal guardian on the Property. The owner may impose additional age or supervision rules for water and heat facilities.

7. Accessibility

The rural property includes natural terrain, gravel paths, steps, decks, and outdoor areas that may not be accessible to every visitor. If you have access needs, tell us in your inquiry and we will describe candidly which lodging, gathering spaces, and routes are likely to work for your party. We are glad to talk through arrangements before you plan a visit rather than after you arrive.

8. Third-party vendors

Caterers, photographers, celebrants, musicians, and other vendors you bring to the Property are your responsibility, including their conduct, equipment, and cleanup. Vendors must follow the same property rules as guests, keep to the areas and times agreed for your gathering, and carry any insurance we reasonably require for their activity. We may decline a vendor or activity that presents a safety or property risk.

9. Photography and media

We photograph the Property and, with permission, gatherings held here, and we may display such photographs on this website. If you appear in a photograph on the site and want it removed, contact us and we will review promptly. We do not claim a media license over guests or event participants by default. Any event photography or publication arrangement should be agreed separately.

10. Personal property

You are responsible for your own belongings and vehicles while on the Property, including in shared spaces, lodging, and parking areas. Lock vehicles and keep valuables with you; the Property is rural and largely open. We are not responsible for loss, theft, or damage to personal property except to the extent caused by conduct for which applicable law makes us responsible. If you leave something behind, contact us and we will make reasonable efforts to locate and return it at your cost.

11. Property damage

You are responsible for damage to the Property, its structures, furnishings, and equipment caused by you or your party beyond normal wear and tear. Please report any damage or breakage promptly so it can be addressed before it worsens or affects another guest. Documented repair or replacement costs may be billed to you, and any deposit or damage-billing terms will be stated in the applicable written agreement.

12. Website use

You may browse and share this website for personal, non-commercial purposes. Site content, photography, and text are owned by us or licensed to us and may not be reused, republished, or used to train commercial datasets without permission. You agree not to probe, disrupt, or overload the site, not to scrape it at scale, not to misrepresent your identity in submissions, and not to attempt access to the private administrative areas. Links to third-party sites or services are provided for convenience and are not endorsements.

13. Disclaimers and limitation of liability

The website is provided as is, without warranties of uninterrupted availability or complete accuracy. Descriptions of lodging, spaces, and events reflect the Property as we know it and may change as the land and its structures evolve. Nothing on this site is professional, medical, or safety advice, and nothing in these Terms limits liability that cannot be limited under applicable law.

14. Force majeure

We are not liable for failure to host a confirmed stay or gathering caused by events beyond reasonable control, including weather, wildfire, flood, power or water failure, or governmental order. Any rebooking, refund, or other remedy will be governed by the applicable written agreement and applicable law.

15. Dispute resolution, governing law, and venue

If a disagreement arises, contact us first; most concerns can be resolved directly and in good faith. These Terms and any dispute arising from your use of the website or your visit to the Property are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any proceeding that cannot be resolved informally shall be brought in the state or federal courts located in the Texas county where the Property is located, and you consent to that venue.

16. Changes to these Terms

We may update these Terms as the Property, its offerings, or the law change. The date at the top of this page reflects the latest revision, and material changes will be posted here. Please review this page from time to time; your continued use of the website or the Property after a change takes effect constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and, where possible, reformed to reflect its original intent. The remaining provisions stay in full effect. Our choice not to enforce a provision in one instance is not a waiver of the right to enforce it later.

Formal notices under these Terms should be sent in writing to that address, and requests about your personal information are handled as described in our Privacy Policy.
